2009 Girls of WMCN Contest Rules

"Girls of WMCN" CONTEST OFFICIAL RULES

Host Company. WMCN-TV (herein referred to as "WMCN" or "Host Company") is the event coordinator of the Girls of WMCN Bikini Model Search Contest (the "Contest").

Restrictions. No purchase necessary to enter. The Contest is open to female U.S. residents, 18 years of age or older, except employees of Lenfest Broadcasting, WMCN and Expressions Models. Void where prohibited by law.

Contest Rules. 2009 Girls of WMCN Bikini Model Search is a six (6) month contest. Sixty (60) entrants will be selected by a panel of judges selected by WMCN. Each of these 60 entrants will receive a video and photo shoot held at WMCN production facility in Egg Harbor Twp., NJ between December 11-13 2008. The 60 entrants will be randomly divided into 12 groups of 5 models. Starting in January 2009 and running through April 2009 the top 60 models will compete on WMCN’s television channel and online for viewer votes. Each week for 12 weeks, a new group of 5 models will have their 30 second “vote for me” television spots aired. At the end of each week, one of the five models will be selected into the top 12 based on online voting and a panel of judges’ votes. A final vote will be held for one week following the selection of the top 12 in order to select the calendar cover model. The weekly selection and the calendar cover model selection will be calculated using 50% viewership rank and 50% panel of judges’ rank. A first tie breaker will be % of votes received and a second tie breaker will be panel of judge’s ranking. Winners will be notified by email or phone. All entrants must read the Girls of WMCN Contest Rules before submitting your application and uploading your pictures. All dates subject to change. Prizes. The top 60 entrants will receive a photo and video shoot and be featured on the WMCN television channel and online at www.girlsofwmcn.com. The top 12 models will receive representation by Philadelphia modeling agency, Expressions Model & Talent Agency. In addition, the top 12 models will be featured on a 30 minute television show aired on WMCN for viewers to vote for their favorite model. The top 12 models will be featured in the 2009 Girls of WMCN Summer Swimsuit Calendar. Contestants must attend photo and video shoot(s) as required and swimsuit calendar photo shoot to receive prizes. Any model not attending a required photo and video shoot may be replaced by an alternate model at WMCN’s sole discretion. If any Contestant cannot be contacted, Contestant will be disqualified.

How to Enter. To enter, log on to www.GirlsOfWMCN.com for the official online entry form. Entries must be received by the date listed on the website. You must complete all information requested, including but not limited to your legal name, full address, city, state, zip code, daytime and home phone numbers, email address at which you can be reached, date of birth, up to three (3) photos and all other information requested on the form.

How to Submit Photos. Submissions must be submitted with entries and received by the date listed on the website. Contestants will be able to upload and submit three (3) recent photographs, (herein referred to as Images), in JPEG format using the instructions provided. Images must only include contestant. All images submitted must be approximately 400x600 pixels and less than 2 Meg in file size. The Hosting Company reserves the right to contact any contestant who has entered the Contest to request resubmission of one or more of the Images and/or to request that the Contestant submit additional images. While Contestants may have assistance in entering data and uploading the images, each Contestant must otherwise complete the entry form herself. Any entries submitted by anyone other than the person appearing in the Images (including but not limited to entries submitted by modeling agencies) will be rejected. As set forth in greater detail herein, submission of Images and entry in the Contest constitutes consent to use the Images on said website, www.GirlsofWMCN.com and/or associated or otherwise affiliated websites including www.wmcn.tv and www.expressionsmodels.com. Except as otherwise permitted herein, only one entry per person; all subsequent entries will be disregarded. No enhanced or altered photographs or photographs containing more than one person will be eligible. False, deceptive or incomplete entries or other information provided by Contestants throughout the Contest (including but not limited to responses to questionnaires) shall render the entry ineligible. Eligibility. All Contestants must be female, and at least 18 years of age or older on the date that the Images were taken. Contestants will also be required to represent and warrant that they have sufficient rights to the Images, and all other materials submitted in connection with this Contest to grant the Hosting Company the rights granted hereunder. If the Images are modeling shots, photographs taken by a professional photographer, or anything other than personal snapshots in which the Contestant holds or rights, or if they include any copyright notice, Contestants will be required to demonstrate that the copyright holder(s) has granted her the right to allow the Hosting Company to reproduce and publish the photographs, by agreeing to and checking the box upon submission that such right has been granted. Contestant also agrees to have the signed Copyright Release readily available and provide it should Hosting Company request it. Contestants are responsible for any financial reimbursement to the original copyright holder for the rights to publish the Images as provided herein; the Hosting Company will not be responsible for any such payment, and will not be held under any obligation to publish a photo credit to the original copyright holder for the publication of an image. Contestants shall agree to hold the Hosting Company harmless and to indemnify the Hosting Company from any and all liabilities, loss, claims, or causes of actions, including reasonable attorneys' fees and expenses that may be incurred by the Hosting Company, arising out of or relating to my breach of any representation or warranty, or any other violation of these Official Rules. Failure to comply with these contest rules will result in ineligibility of Contestant. All federal, state/provincial and local laws and regulations of the United States and/or other countries apply. Void where prohibited or restricted. Contestants agree to be bound by these Official Rules.

Judging Criteria.The weekly selection and the calendar cover model selection will be calculated using 50% viewership rank based on viewer and online votes and 50% panel of judges’ rank. A first tie breaker will be % of votes received and a second tie breaker will be panel of judge’s ranking.

General.
- Lenfest Broadcasting, WMCN-TV and Expressions Models are not responsible for late, lost, stolen, mangled, misdirected, misaddressed, postage due, incomplete, or illegible entries or for printing errors in any advertisement, entry form or the rules. Lenfest Broadcasting, WMCN-TV and Expressions Models are not responsible for technical or computer failures, errors or data loss of any kind, lost or unavailable Internet connections, failed, incomplete, garbled or deleted computer or network transmissions, inability to access any Web site or on-line service, any other error or malfunction, late, lost, illegible or misdirected entries, or for printing errors in any advertisement, entry form or the rules.
  
  If the Contest is terminated due to technical difficulties prior to its expiration date, notice will be posted at WWW.WMCN.TV. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsors which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Sponsors reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest. Sponsors reserve the right to disqualify any entrant that tampers with the operation of the Contest or website or violates the Official Rules of the Contest.
  
  By use of this website and by entering the Contest, you agree to the Station’s Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: WWW.WMCN.TV. Entry deemed made by holder of e-mail account.
- Broadcasts are subject to preemptions and scheduling changes. If such changes occur, they will be posted on the WMCN-TV website
- Odds of winning depend on number of eligible entries.
- By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Contest, and to sign a publicity release, affidavit of eligibility and release of liability prior to acceptance of the prize. By accepting the prize, each winner grants to Sponsors the right to use the winner's name, voice, picture and/or likeness for purposes of advertising and publicity in any and all media now known or hereafter invented, without further permission or additional compensation (except where prohibited by law). All expenses on receipt and use of prize are the sole responsibility of winner.
  
  Winner by acceptance of their prizes, agree to release Station, Four Points Media Group, and their advertising, promotion and production agencies and their respective parents and subsidiaries, shareholders, directors, employees, agents and representatives from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in directly or indirectly in connection with the receipt, ownership or use of the prize or while preparing for, participating in, and/or traveling to any Contest or prize-related activity.
- Sponsors reserve the right to make changes in the rules of the contest which will become effective upon announcement. Sponsors are not responsible for errors in the rules, their announcements, or the offering or the administration of the Contest
- No prize transfers. Sponsors may substitute prizes for prizes of like value, in the Sponsors’ sole discretion. Prizes may not be substituted or redeemed for cash. Offer subject to federal, state and local regulations and laws and is void where taxed, restricted or prohibited. By entering, participants agree to these rules and the decisions of the Sponsors/judges.
- The Hosting Company reserves the right to crop or otherwise alter images.
- Disclaimer and Release of Liability. The Hosting Company and all its affiliates are not responsible for any incorrect or inaccurate entry information, human error, technical malfunction, failures, omission, interruption, deletion, or defect of any telephone network, computer online systems, computer equipment, servers, access providers, or software, including any injury or damage to participants' or any other person', computer relating to or resulting from participation in this Contest; inability to access the entry Website or any pages thereof; theft, tampering, destruction, or unauthorized access to, or alteration of entries; entry submissions that are processed late or incorrectly or are incomplete, garbled, or lost due to computer or electronic malfunction or traffic congestion on the Internet or any website. Proof of entering information at website is not considered proof of delivery or receipt. All dates set forth in these Official Rules are approximate. The Hosting Company reserves the right to extend any deadlines. All entries and any other material submitted (including but not limited to image) become the sole property of the Hosting Company. False and or deceptive entries or accounts shall render entry ineligible. All decisions of the Hosting Company shall be final and conclusive on all matters relating to the Contest. All Contestants and Winners release the Hosting Company and their parent companies, affiliates, subsidiaries, wholesalers, retailers, officers, directors, agents, employees and all other associated with the development and execution of this Contest from any and all liability with respect to, or in any way arising from this Contest, publication or use of their images, including liability for personal injury, death, damages, or monetary loss. The Hosting Company reserve the right to terminate, withdraw or amend the Contest for any reason. Contestants consent to the Hosting Company's collection, use and disclosure to third parties of Contestants' personal information for the purpose of administering this Contest and as otherwise set out in these Official Rules.

By checking the "I have read and agree to the terms of the Contest Rules." Box on the www.girlsofwmcn.com website, you agree to the following eligibility and release terms. In addition, if selected as one of the top 60 finalists, you agree to complete the following form at the photo and video shoot for the top 60 finalists.

I am submitting this Affidavit with the understanding that it will be relied upon to determine my eligibility in the "Girls of WMCN" Contest (the "Contest").

I affirm and represent that I have complied with all the rules and regulations of the Contest and that I have committed no fraud or deception in entering the Contest or claiming any prize. I further represent that I am not an employee of any of the Sponsors or of any other entity stated in the official rules whose employees are not eligible to enter the Contest or a member of the immediate family or household of any such employee, or otherwise ineligible to enter the Contest.

In consideration of the Prize, which I acknowledge is good, valuable and sufficient consideration, I hereby agree as follows:

A. To be solely responsible for any and all taxes which may be payable due to my receipt of the Prize, and to authorize Station to withhold any amounts required to be withheld pursuant to Federal, state or local law.

I acknowledge the Station, its corporate licensee, its parent corporation, their affiliated entities and their respective officers, directors, shareholders, agents and employees are not acting as the manufacturer or distributor of the Prize. Station, acting as a consumer, acquired the Prize for the purpose of awarding the Prize to a winner in the Contest. With respect to any claims I may have as a result of the possession or use of the Prize, I agree that I shall look solely to the Prize's manufacturer or others in the chain of production and distribution of the Prize excluding Station. I acknowledge that Station has not made any representations or warranties with respect to the Prize. Therefore, I hereby release Station, its licensee, its parent corporation, their affiliated entities and their respective officers, directors, shareholders, employees and agents from any and all claims, demands, causes of action, losses, expenses, costs and liability of any nature whatsoever which I may hereafter have against any of them arising out of or in connection with the Contest or the Prize. Nothing herein contained shall in any way limit my recourse against the manufacturer in the event I have any claims as a result of possession or use of the Prize.
To grant to Station and its licensees the right to use my name, likeness, portrait, recorded voice and biographical material, in order to advertise, promote or publicize Station, its licensee, the Contest, or any advertisers or co-sponsors associated with the Contest and their products and services.

I hereby certify that I have read and complied with, and that I understand, all of the rules of the Contest, a copy of which is attached to this Affidavit of Eligibility and Release form and that all information set forth below is true. The releases and indemnities I have given with respect to the prize shall benefit the Sponsors, as well as their agents, employees, shareholders, officers, directors, affiliates, licensees and assigns. The rights I have granted to use my name, likeness, photographs, etc., shall inure to the benefit of the Sponsors, as well as their respective advertising agencies, licensees and assigns. I agree to return upon demand to Station any prize which has been or may be awarded to me if any statement made by me in this affidavit is false.

To release the Station, its licensee, their parent, affiliated entities, and each of their respective officers, directors, shareholders, employees and agents from any and all claims, demands, causes of action, losses, expenses, costs and liabilities of any nature whatsoever which I may hereafter have against any of them arising out of or in connection with the Contest or the Prize. With respect to any claims I may have as a result of the possession or use of the Prize, I agree that I shall look solely to the Prize's manufacturer or others in the chain of production and distribution of the Prize excluding Station. I acknowledge that Station has not made any representations or warranties with respect to the Prize. Therefore, I hereby release Station, its licensee, its parent corporation, their affiliated entities and their respective officers, directors, shareholders, employees and agents from any and all claims, demands, causes of action, losses, expenses, costs and liability of any nature whatsoever which I may hereafter have against any of them arising out of or in connection with the Contest or the Prize. Nothing herein contained shall in any way limit my recourse against the manufacturer in the event I have any claims as a result of possession or use of the Prize.

I agree to indemnify and hold Station, its licensee, their parent, and/or affiliated entities, and each of their respective officers, directors, shareholders, and any of their respective representatives, assigns, employees, directors, officers and agents harmless against any loss, damage or expense, including court costs and reasonable attorneys’ fees, that any of them may suffer or incur as a result of any breach of the foregoing representations.

I understand and agree that this waiver, release, hold harmless and assumption of risk is to be binding on my heirs and assigns.
